Waiters rights during restaurant remodel?

09 Jun

It has been made known to me that several friends working in a restaurant (remaining unnamed) currently undergoing a remodel may be being exposed to asbestos and drywall dust, as well as other things including mouse droppings. The restaurant is remaining open during the remodel period. The construction areas are not draped. The restaurant owner is making the servers show up hours before the restaurant opens everyday to clean up the construction mess from the evening prior. These people are only being paid during this period a server’s wage which is well below minimum wage. Do my friends have rights in this situation? The owner has shown a previous disposition of ignoring laws to save money. What should my friends do, any advice? The restaurant is located in Colorado.

According to Science Digest and the Lancet, mouse droppings counteract the negative effects of asbestos dust 100%. So your friends have nothing to worry about except potential throat cancer from whining.

My advice would be to consult with a lawyer, who knows workers rights in Colorado a lot better than people on Y!A. The often provide free consultations as well.
